The FBI Had No Executive Power to Withhold Anything

The political act came first, and it did not come from Donald Trump. Pfaff names it directly: Nikki Flores of the FBI withheld this China intelligence from the Presidential Daily Brief in 2020 — for political reasons. She and others claimed the information would be too political and that the president would misuse it. Staffers decided what a president can and cannot know.

That decision collides with the plain text of the Constitution. Article II, Section 1 vests the executive power in a President of the United States — the elected president, and nobody else.

The only executive power any federal employee operates under is power granted by the elected president. The FBI officials who held back the China intelligence made that call on their own, without any consultation with Donald Trump. That, Pfaff says, was the shadow government Flores described — that was the political move. Trump’s speech was the opposite: an executive dealing with the threat through his staff and telling the American people what steps he is taking. Pfaff, who ran two congressional staffs, names the distinction the public misses: it is not illegal to do political things — it is illegal to do campaign things. If the political accrues to Trump’s benefit, that is fair game.

How China Got 220 Million Voter Records

Pfaff then corrects his own former boss. Congressman Thomas Massie — Pfaff served as his chief of staff — posted on X that China can get access to anything, since voter records in Kentucky are available to anyone. Pfaff double-checked, and Massie was totally wrong. To get Kentucky’s voter registration data, you have to be a campaign or an organization undertaking a ballot measure, you have to fill out a form with the Secretary of State, and if they are willing to give it to you, you have to pay $4,000 for it.

China went behind a firewall — a firewall that did not exist as late as the 1990s and early 2000s, when Pfaff himself pulled voter files from public websites in any state he worked in. That era is over for a reason. Worse, the stolen files contain personal information no election authority should ever give out: Social Security numbers and the identifying data that now rides along with registration because of motor voter laws. When you get a driver’s license, most states automatically register you to vote, transferring your personal data into the voter file. China got that information too.

What China Can Do With Stolen Voter Registration Data

Rick Trader asked the operational question: how can the Chinese use it? Pfaff lists the known plays. One scheme they were specifically designing: take real names from the stolen files, manufacture fake IDs in China, ship them to the United States, and use them to register people in a chosen place — hijacking a citizen’s registration so the ballot goes somewhere else. The data also enables fake mail pieces built to confuse Americans about the election, and because the voter file includes voting history, a foreign actor can pick exactly which Americans are the best targets for disinformation. With Social Security numbers in the files, identity theft is on the table too. Pfaff adds that the Chinese government has hacked federal employee records as well; as a former federal employee, he is pretty certain his own information is in their hands.

Domestic hackers stealing voter registration data would be illegal too. But a foreign government weaponizing it against our elections is a different order of threat — serious enough, Pfaff argues, for Trump to take further executive action against these countries to make them pay. Trader added a detail from the president’s speech: the Chinese Communist Party was also reproducing driver’s licenses, divulged shortly after the 2024 election.

Four States Under Investigation — and New Jersey’s Admission

The hosts brought the story home. Senator Markwayne Mullin says four states are under investigation — Nevada and New Jersey among them, the states Conservative Commandos broadcasts from. Can the feds simply take over those elections? No, Pfaff says — the Constitution says the states run their elections, and that is a constitutional firewall. But the federal government is far from powerless. Trump controls the Post Office — it sits under the executive branch, not independent of it — and must stay strict about mail ballots, because the Post Office must not operate in a fraudulent manner, the same principle behind federal wire fraud law. And the Department of Justice must move on the states themselves. New Jersey just handed them the reason.

That refusal is itself a legal problem. Federal law requires states to make their election records available to the federal government — a strict provision, with criminal consequences for violating it. Mullin says non-compliant officials are going to jail; the hosts pointed to Nevada Secretary of State Aguilar, who becomes part of the problem if he does not comply with the audit. Pfaff goes further: every state election official refusing to comply should be handcuffed and perp-walked now, because they are violating the law now. States run their elections, but they are not allowed to run them in a fraudulent manner — and even one illegal alien registered to vote is a violation of the law.

Why are there hundreds of thousands, even millions, of illegals registered to vote in this country? Because many states give illegals driver’s licenses — documents that serve as proof of residency for people who are not valid residents, feeding registrations through motor voter. Pfaff has relative confidence in Todd Blanche and a lot of confidence in Harmeet Dhillon at DOJ, who has hit brick walls in courts around the country and needs to get more aggressive. Donald Trump is duty-bound to adjudicate this — prosecutorial discretion is not allowed here. It is the heart of the election integrity agenda TCC has tracked since Trump took office.

Get Rid of Computer Voting Machines

The most alarming disclosure from the reports, Pfaff says, is that the intelligence community found hard evidence China was able to do some of these things — including having processes available to hack Dominion machines. Pfaff is precise about what is and is not proven: nobody has established that China pulled that trigger. The proven capability is the problem, because at whatever point they want to use it, they can.

There is no need for them. All three on the air grew up when precincts ran the elections and ballots were counted in the precincts — paper ballots or mechanical lever machines with no computer access of any kind. That custody chain is why America had the gold standard for elections for more than two centuries. Trader put numbers on the suspicion: 15 million more votes were cast in 2020 than in 2024, and Georgia saw pallets of mail-in ballots that were never folded — Angle’s question: how do you get a ballot into an envelope without folding it? Pfaff’s answer is structural reform. The Save America Act would bring the country very close back to precinct-counted voting — the same fight TCC covered in the Senate battle over the Save America Act.

He closes with a challenge to his own side. Democrats, afraid of losing every election by the late 1990s, sent Norm Eisen and Marc Elias to challenge election processes nationwide with hundreds of millions of dollars in lawsuits, and Barack Obama’s machine did the same. Republican elected officials and party leaders are typically feckless and weak, and they don’t counter it. Whatever is legal in California — a state whose election laws make fraud legal — Republicans ought to be doing too, to win elections. Not illegalities: working the legal process. The major problem is that the processes are weak, and they need to be strengthened.
