Analysis: Conservative Caucus President Jim Pfaff
Seven days before Election Day, Robert McNeily, filling in for Jenny Beth Martin on The Jenny Beth Show, opened on California’s mail ballots. A federal appeals court had let the state keep counting about 20,000 ballots the Justice Department flagged, on a 2 to 1 vote, and the case was headed back to the district court.
Conservative Caucus President Jim Pfaff said the court never reached the merits. The rolls are a mess, he said, and California does not really hold elections. “They have selections.”

20,000 Ballots and a Messy Roll
Pfaff said the appeals court found the case was not ripe. The Justice Department is pushing because the election is a week away. Estimates, he said, put more than a million people in California improperly registered, or without a claim to vote. That mix includes illegal aliens and people who have moved in or out of the state.
The rolls are messy, and mail-in voting has no chain of custody he can point to. Unlimited vote gathering lets people go to doors and urge a different vote. Automatic ballots for everyone on the roll, he said, are bound to produce fraud. This case is “the tip of the iceberg.”
I don’t even think you can rationally say that California actually has elections. They have selections, and they just go through an election process to make it look like there’s something valid going on.
He said the whole system should be thrown out.
The Save America Act and 230 Years of Same-Day Voting
Pfaff said an enforcement tool already exists. Laws from the 1990s let the Justice Department ask states to look at voter rolls. States are refusing to let that process work. Courts and the way election systems have been allowed to run are part of the problem too. The Save America Act still has to pass.
“The reality is we do have people voting who ought not to vote. We know that for a fact now.” Article 1 lets states write election laws, he said, and Congress may regulate them. Congress already has, in the Civil Rights Act, Johnson-era election laws, UOCAVA ballots for soldiers and people overseas, and the motor-voter law.
Motor voter, he said, is a major registration problem. License branches automatically register people who should not be on the rolls. The disenfranchisement claim, in his telling, mixes a view that Black people cannot get a driver’s license with a desire to auto-register people and muck up the system. The Trump administration is trying to clean it up. States are not cooperating.
“We need the Save America Act because it would… tie in the loose ends of a lot of these laws and bring us back to the election system we had for about 230 years.” That system, he said, was same-day voting, mail ballots limited to people who are invalids or traveling for business, and an affidavit the voter must request and sign under criminal penalty.
Without those rules, he said, Americans will not have confidence. He pointed to Brazil, where some stations were closed and others left open for Lula da Silva, the candidate who supposedly won, and those places were opened for 2 hours. The rules changed in the middle of the game. “gotta close this loop, and immediately.”
Don’t Listen to the Polls
Polling may not be entirely broken, Pfaff said, but it is a bad way to judge what is happening. Polls tell you something. You still have to judge past them. They have underreported Republican support in 2016, ’20, and ’24, underestimating Donald Trump and overestimating Democrats. Even in these off-year elections, the margins favor Democrats.
The turnout model that works for Republicans, he said, is the one where people who usually skip midterms show up. “Don’t listen to what the polls say. Go get out and vote.”
People who claim Christian faith can be among the worst at staying home. About a quarter, maybe at best 30%, vote. That leaves 3/4 to 2/3 who do not. He cited Megan Basham’s Shepherds for Sale, on the left funding so-called Christian groups to urge Christians not to vote. That push, he said, followed the rise of the Christian right in the late ’90s and early 2000s.
Calling integrity advocates election deniers misses the point. “There is no government process, no political process, no electoral process that doesn’t require vigilance to make the standards work properly.” He has worked elections since the 1990s and campaigns for over 30 years. Processes were never perfect. For about the last 20 years they have been highly imperfect. People who care about the republic should vote and watch their local elections. Done together, he said, that could win almost every cycle.
Call Friends, Then Watch the Polls
The first job this week, Pfaff said, is to call friends and family and urge them to vote. Next, watch the voting place. That includes early voting now and Election Day on November 3rd. If something looks wrong, report it to local authorities and to the county or state party. The RNC has a legal team of thousands of lawyers.
The Justice Department’s Civil Rights Division under Harmeet Dhillon handles elections, he said, with thousands of lawyers. Call the Justice Department or the FBI. It is late for most people to sign up as poll workers. Watching and reporting can still expose a problem while this administration is willing to make elections run fairly.
“Democrats are going to be out there all the time saying that Donald Trump’s trying to meddle with elections. That’s a lie.” His Justice Department, Pfaff said, is trying to rein in problems that already exist. Democrats are trying to create chaos. Some Republicans, given human nature, may want to cut corners. That is not the problem right now.
Comey, the 10-Year Clock, and Lady Justice
Pfaff said he is not a legal expert, and to take this with a grain of salt. Filing matters because it sets a marker inside the statute of limitations. Many crimes and civil claims must be brought within a set time. Here that is 10 years. Other Comey conduct inside a 10-year window could be pursued. This one is serious.
“James Comey is one of the most crooked actors of anyone that has served in… the federal bureaucracy,” he said, and he tried to undermine democratic processes. A criminal information before a grand-jury indictment is an attempt to stay inside the limit. Pfaff is not sure how firm that step is. Judges now, he said, often work around the law.
After more than 10 years of lawfare against Donald Trump, for reasons Pfaff said are already shown invalid, the people who ran that lawfare have to be pursued. It almost never goes against Democrats. When it does, they have left the reservation. Robert Menéndez’s second charge, of which he was convicted, had real merit. An earlier charge, Pfaff said, would not have been brought if Menéndez had not fought Democrats on Israel.
For political actors, the legal system has been a political tool. “Lady Justice is supposed to be blind.” She is not supposed to care about money, origin, family, or politics. Democrats, he said, do not stand by that. Comey fudged the Hillary Clinton email issue in 2016. He made her look bad, and he did not seek charges or a Justice Department referral when, Pfaff said, we now know he should have.
This injustice stops only if the people who commit it pay a legal price. That is what the Justice Department is attempting.
A Senate of 50 to 53, and a House That Is Leaning
Pfaff called this one of the most confusing elections he has been part of, and still exciting. He is watching Ken Paxton versus James Talarico in Texas, and Mike Rogers versus Abdul El-Sayed, whom he also called Abdul Saeed, in Michigan. He called Saeed a confirmed Islamist and a Muslim Brotherhood supporter who is not getting the Black support a Democrat usually gets in Detroit. A cadre there, he said, is with Rogers. That race tells him the electorate is changing.
Donald Trump got 20% of Black males in 2024, he said. The Hispanic vote, traditionally about 65% pro-Democrat, shifted to about 45 to 55% in 2024. Also watch New Hampshire, where former governor Chris Sununu could take a Democratic seat, and Susan Collins in Maine.
The Conservative Caucus is working in every state he named, plus key House races. Virginia districts 2 and 6 matter, one to hold and one to pick up. A couple of California races matter for the totals. Most of the opportunity, he said, is in red states that redistricted against years of Democratic gerrymandering, including Texas and Florida, to try to keep the House.
“I think Republicans are going to keep the Senate. It’s going to be somewhere between 50 to 53 votes.” At 50 the Senate is tied, and J.D. Vance, as president of the Senate, would break the tie and be busy. Keeping the current majority would help if the House goes Democratic. Oddsmakers treat a Democratic House as almost foregone. He does not. It is leaning that way, and it would cause grave challenges for the next 2 years.
If Hakeem Jeffries’s caucus wins a narrow majority, Pfaff sees a pretty good likelihood Jeffries does not become Speaker. The party is embracing radical socialism and communism because those candidates are winning. Something like 3 to 7 or more democratic socialists could arrive, and they will demand a radical-left speaker. Jeffries should expect a challenge.
Key Takeaways
- Selections, not elections: Pfaff said California’s process is dressed up to look valid, and the flagged-ballot case is the tip of the iceberg.
- Save America Act: He wants the act to restore about 230 years of same-day voting and tightly limited mail ballots.
- Christian turnout: About a quarter, maybe at best 30%, of people who claim Christian faith vote, and he told the rest to show up.
- Watch and report: Call friends, watch early voting and November 3rd, and report problems to the party, the FBI, or the Justice Department.
- Comey: He called Comey one of the most crooked actors in the federal bureaucracy, and said the filing is meant to stay inside a 10-year limit.
- Senate 50 to 53: He expects Republicans to keep the Senate and says a Democratic House is leaning, not foregone.
