Make Election Day One Day Again

Analysis: The Conservative Caucus


This week, the Supreme Court heard arguments on the Watson v. RNC case to make Election Day one day again.

Six Justices appeared to strongly or mildly oppose the receipt of ballots later than election day, offering hope for a more secure election this year.

Especially during Covid, mostly Democrat states legalized mailed-in ballots and many allowed those to be received many days after election day.

Some states require a postmark, others don’t—ballots could have been mailed a week after the election and be counted!

The essential ‘chain of custody’ ends when ballots are stored in warehouses or closets, especially for many days, offering opportunities for tampering.

Such long delays offer serious risks for fraud or lost ballots through intent or accident.

Justice Alito’s Unvarnished Questioning

Justice Samuel Alito offered unvarnished responses to the Democrat’s petitioner, Scott Stewart, the Solicitor General in Jackson, Mississippi.

“So there’s no limit [to voting after election day]? Except I suppose the day when the presidential electors have to be appointed or the day when the next Congress starts its session, that’s the only limit?”

“Well, why shouldn’t we read Election Day the way we read all kinds of other days that appear in statutes?

“We have lots of phrases that involve two words, the last of which, the second of which is day, Labor Day, Memorial Day, George Washington’s birthday, Independence Day, birthday, and Election Day, and those days don’t mean a week, they don’t mean a month, they mean a day. Why isn’t Election Day the same?

“So, if we start with that, if I have nothing more to look at than the phrase ‘Election Day,’ I think this is the day in which everything is going to take place.”

Paul Clement’s Chicago Allusion

Paul Clement, counsel for the Republican National Committee got both Justices and the audience laughing at this allusion to Chicago’s infamous election fraud: “Now I’m not here to say that there could never be a dead person who votes after Election Day, but…”

Clement also correctly observed that “the day of the election is the day when it’s the last day in which all the ballots are cast and they are received into official custody.”

The Invitation to Fraud

Here’s an invitation to fraud. If a corrupt Democrat candidate learns on election day that he’s lost by 1,000 votes, and ballots can keep arriving for many days, it opens up opportunities to have 1,500 fraudulent ballots filled out and sent in.

A win on this Supreme Court case would be an important element in restoring secure elections, and restoring public confidence that winners only won honestly. Unlike bills that must pass the Senate, a Supreme Court win is final. Done. Over. No filibuster, no games.

The SAVE America Act

Passing the SAVE America Act will add even more safeguards for American voters.

Some states like California require no IDs at all and instant registration. That empowers Democrats to send their paid teams and illegals from one precinct to another to another; each time registering and voting illegally.

Photo ID and purging illegals from the rolls will allow Americans to have their votes count fully.

Election fraud is a far greater threat to our republic than many think. This Supreme Court’s decision is a vital step in restoring integrity to our elections.

There’s more work to be done.

If the Supreme Court rules against birthright citizenship, that will block millions of future voters who have no right to citizenship and to vote in our elections.

The 2020 Fraud Remembered

Most people remember the open fraud committed during the 2020 election. Counting was halted in places and observers then sent home—but resumed after the observers left. Photos of ballots being unloaded from vans in the middle of the night.

Counting where observers were not allowed to observe—or kicking them out of the room and covering up the windows. Reports of voting machines being hacked.

Following that election, the GOP and others organized rapid-response teams of lawyers to assure access by observers, which made the 2024 election less fraud-prone. But they can roll out those tactics again if there are new opportunities.

Ballot Harvesting & Illegal Voting

Then there’s Democrat states where ‘ballot harvesting’ is legal, allowing leftist activists to go door-to-door picking up ballots. Those from GOP households or zip codes could be thrown away, and activists can pressure and intimidate voters about their choices.

The Democrat activists and their non-profits work to register illegal aliens to vote, and turn them out to vote for Democrats.

How Mail-In Ballots Can Be Rigged

Here’s one method to rig mail-in ballots: Place punched holes in the reply envelopes to show who you voted for.

Virginia’s Fairfax County put a hole that ‘happened’ to exactly line up with the mark for a Republican candidate.

The practice was widespread across California, as seen in this Sacramento envelope. Again, clearly showing how a person voted.

Why? Dishonest election officials or mailmen could easily trash those. Blatant fraud.

Whether it’s the SAVE America Act or anything that would prevent voter fraud, Democrats go nuclear in their opposition. Which begs the question: If they say there’s no voter fraud and illegals never vote, why are they so opposed to measures that would prevent it?

Looking Ahead

With the promising support of the Supreme Court, we may have safer elections this year.

And with your continued pressure on Senators, we might be able to pass the SAVE America Act with a historic talking filibuster.

  1. Call Senator Thune and demand he recesses the Senate each evening and on weekends, not formally adjourn. That limits each Senator to only speaking twice under the ancient rules, and enables passing the SAVE America Act with a talking filibuster.
