Gut the Electoral College, Pack the Court: Jim Pfaff on The Jenny Beth Show | Aug 3, 2026

Kamala Harris said it out loud: revisit the Electoral College, expand the Supreme Court to 13 justices, revisit statehood for Puerto Rico and D.C. On the August 3 edition of The Jenny Beth Show, host Jenny Beth played the clip and asked Conservative Caucus President Jim Pfaff what it really means. His answer: the Democrat Socialists of America are simply saying openly what Democrats have pushed for a long time — and what they ultimately want is unilateral control. The conversation then turned to the Save America Act, with the Senate trying to recess on Friday while nearly two dozen of the 53 Republican senators back Mike Lee’s call to stay in session until it passes. The two closed by dismantling the media’s favorite new comparison: that the Democrat socialist surge is the new Tea Party movement.

Jenny Beth opened with the tape. The last Democratic nominee for president, she noted, had said out loud this past weekend that she wanted to gut the Electoral College, pack the Supreme Court, and make Puerto Rico and Washington, D.C. seats. Then the show played Harris in her own words:

“We need to revisit the point of expanding the court to 13 justices like we have 13 district courts. We need to revisit, if they so want, statehood for Puerto Rico and D.C.”

Pfaff’s reaction was not surprise. Harris, he said, is “spouting much of the Democrat Communists of America talking points” — and the interesting thing about the rise of the DSA inside the Democrat Party is that nothing about the agenda is new. Only the candor is.

What They Want Is Unilateral Control

Pfaff urged viewers to decode the language. Take the words politicians use and ask what they are really trying to communicate. Going back into the Obama administration, he argued, what Harris is communicating is the Democrat Party platform: unilateral control of the United States of America. Not free and fair elections, not elections that work for all Americans — elections that work for them. His exhibit A is California, where election outcomes cannot be monitored or verified:

The constitutional stakes are specific. The Constitution, Pfaff pointed out, guarantees a small-r republican form of government — a representative democracy where the people choose representatives who serve at their will. The Electoral College is, in his words, “the most firm approach to electing a president that is in the will of the people generally”. Remove it, then pack the Supreme Court, and the pattern is unmistakable:

The Oath of Office and the Politburo

Then Pfaff went somewhere Jenny Beth said she had not heard anyone go. The DSA members who won Democrat primaries — three in New York, one in Denver — are openly saying they do not support the Constitution. The oath of office requires not only upholding the Constitution but swearing the oath without a hidden agenda. His conclusion:

“because they are out saying that they don’t support the Constitution, I don’t even think that if Republicans maintain control that they should even seat them”

What the Agenda Actually Calls For

Look at the platform, Pfaff said: “the elimination of the Senate, putting the executive branch under control of the House of Representatives” — with the Supreme Court next, even if they are not saying so. Everything underneath the House is, in effect, a parliamentary system. “We’re not a parliamentary system.”

But Pfaff argued the parliamentary label is still too generous. The Soviet Union held elections its entire existence; they meant nothing, because the power brokers in Moscow ran everything and an elite class literally ruled over everybody.

The point of that structure, he said, is to eliminate any potential for families to create wealth, strip away free market controls, and run the country as a centralized planning environment. Jenny Beth traced the lineage back a full century — to 1913, maybe 1912 — and warned that the sales pitch of free everything ends, in Pfaff’s words, in “a race to the bottom where we’re all equal, but we are equally miserable, equally have nothing, and equally have no opportunity for advancement.”

Save America Act: Stay in Session Until It Passes

The Senate is trying to recess on Friday. Pfaff’s message: not until the Save America Act passes. The hope, he said, rests with Mike Lee and a growing number of senators supporting him — including his good friend Senator Jim Banks — who are increasingly saying the Senate needs to stay in session until the bill is done. The reason is simple: America needs to go back to the gold standard elections it had for its first 230 years, before Democrat court challenges this century stretched Election Day into one, two, in some cases almost three dozen days of voting — a system Pfaff called chaotic, paired with strict absentee rules and voter ID so we know voters are valid. As for Senate Majority Leader John Thune, who has been under sustained pressure on this bill, Pfaff was blunt: he “needs to wake up and do what the American people want to do.”

The pressure is working. By Pfaff’s count, nearly two dozen of the 53 U.S. senators already support Mike Lee’s call to keep the Senate working through the August recess. His marching orders for activists: call your senator, call the congressional switchboard, and do not let the pressure go away.

The Polling: 82% Say Citizens Only

Jenny Beth put the numbers on screen. Her organization first polled the question in early 2024, found support above 80% for citizen-only voting, and has kept polling it ever since — and the support has not moved:

“82% say only U.S. citizens should vote in American elections. 78% should show a photo ID when casting a ballot. 78% should show proof of citizenship when registering to vote.”

That is a supermajority of Democrats, independents, and Republicans alike, she noted — and the problem is not hypothetical. There are 6,600 noncitizens on the rolls in New Jersey and 3,000 in Alaska, and President Trump said a few weeks ago that four states, including New Jersey, have over 250,000 noncitizens on the voting rolls. We covered the New Jersey noncitizen registration numbers in detail. Democrats are standing in the way of the bill, and Jenny Beth’s explanation was the only one she could come up with: they want those non-citizens voting. The Republican answer should be equally simple — not on my watch.

The DSA Is Not the New Tea Party

Jenny Beth’s townhall.com column this weekend took on the media’s favorite framing: that the Democrat socialist surge is the new Tea Party movement. She and Pfaff were both there at the founding of the modern Tea Party — she started Tea Party Patriots; he was running Americans for Prosperity of Colorado when thousands came to the state capitol to oppose Barack Obama’s stimulus package as he signed it in Denver. That movement was not just conservatives and Republicans, Pfaff recalled — it pulled in the moderate middle of independent voters and added 63 new Republican seats in Congress that year. The DSA comparison fails on the numbers alone:

“It’s not the same amount of people. If you look at polls, the support for that agenda, it doesn’t even break 30% if I’m reading the polls correctly.”

The same media that beat up the Tea Party for asserting what it wanted — the media that, in Pfaff’s words, “lied to us about COVID lied to us about the Russia hoax” — is now standing up the DSA as a similar movement — and he called it a lie. Asked for a 30-second closing message to every senator packing a suitcase for August recess, Pfaff delivered it straight:

“you’re answerable to us. Not your agenda to get out and campaign. Your most effective campaign strategy is to pass a bill that 80% of the American people support.”

The issue polls in the top three for Americans consistently, he added. The plan has been out there since Mike Lee began pushing it. Get it past the finish line, and then go home — otherwise, you’re not doing your job.
